SALE RULES

Entry/Processing Fee: $100

Entries postmarked after August 1, 2010 will be assessed an additional $50 late fee.

1. Signed registration papers, plus a $100.00 per head fee ($75 entry fee, $25 processing fee, processing fee is refunded on bulls that go through the ring) along with the completed entry form must be sent to James Danekas & Associates, Inc., 9960 Business Park Dr. Ste. 170, Sacramento, CA 95827. No cattle will be cataloged without the $100.00 entry/processing fee. Entries postmarked after August 1, 2010 will be assessed an additional $50 late fee per lot. Entry fees are non-refundable. All entries must be signed by consignors.

2. Sale costs will be pro-rated on a per lot basis with the entry fee applied to the pro-rated sale costs. 6¼ % will be deducted for sales commission, plus any other fees directly chargeable to the consignors (ie brand inspection, transfers, Beef Council). Facility fees will be divided equally by the number of bulls that arrive at the sale.

3. Cattle will be graded within each division. Cattle will be sifted for quality and soundness. All bulls must be at the facility by 10:00 a.m. Thursday, October 7th. Sifting & grading will begin Thursday at 4:30 p.m. All Champions will be announced at the Buyers & Consignors Appreciation Night, Friday, October 8th at the TLAY. Food & beverages will be available. Watch for the exact starting time. Consignors are encouraged to be in attendance to visit with past and new customers. A minimum weight of 1050 lbs. will be required. All sifted cattle must be removed from the sale pens by 6:00 a.m. October 9th. No limit on number of entries, however, if numbers exceed the desired amount of entries, larger consignors will be notified and asked to cut some entries.

4. Bulls born between 9/1/08 and 10/1/09 are eligible for the sale. Potential carriers of AM or NH must be tested free of AMF or NHF in order to sell.

5. There will be 3 divisions to the sale:
  A. Low Birth EPD/Calving Ease Division. To be eligible for this section, your bull must have an official performance pedigree with complete individual EPDs from the American Angus Association from the Fall 2010 Report. The maximum birth EPD for this section is a +1.5. The maximum raw birth data cannot exceed 85 lbs. coupled with an EPD of less than the maximum as outlined above. A champion and a reserve champion will be selected in this division. Bulls who qualify as low birth EPD/Calving ease bulls can be entered in the growth or carcass section if you so desire. No bull can be entered in more than one division. Once entered in a division, he must stay in that division. Depending on the number of entries, they made be split into a senior and junior division.
 
  B. Carcass Division: Any bull that has carcass EPDs or ultrasound EPDS with a marbling EPD of +.25 or better and a REA EPD of +.25 or better. Will be eligible for this division. A champion and a reserve champion will be selected in this division. Depending on the number of entries, they made be split into a senior and junior division.
 
  C. Growth Division – Any bull that does not qualify for the section outlined in A or B above must be entered in the growth section. A champion and a reserve champion will also be selected in this division. Depending on the number of entries, they made be split into a senior and junior division.
 
  D. An overall Supreme Champion will be selected from the three division champions. The sales management will determine the sale order as to when the low birth EPD bulls vs. growth bulls vs. carcass bulls vs. fall yearling bulls will sell after the Supreme.

6. The Sale Management may check tattoos, be sure and check your tattoos before you arrive at the sale.

7. All bulls must be semen tested by an accredited veterinarian or a NAAB or CSS approved technician. Semen test must be completed within 30 days prior to the sale. All semen test results must be in the sales office by 5:00 p.m. October 7th.

8. Health Requirements:
  A. All bulls must be vaccinated for Anaplasmosis prior to the sale. Killed Anaplas vaccine may be obtained through your vet or the Californian Wool Growers office in Sacramento call 916-444-8122. The killed is a 2 cc shot, one cc initially and the second cc three weeks later. Plan your schedule so this is done prior to the sale.
 
  B. All bulls must have a negative trich test prior to the sale.
 
  C. All cattle must be eligible for interstate shipment. Consignors are responsible for all tests that would be necessary for shipment outside of California. These test would have to be completed after the sale and will be seller’s expense.

9. Sale order will be from oldest to youngest by grade in each division. The sale order of the division will be left to the discretion of the Sale Management. The Supreme Champion will begin the sale.

10. Entry fee is forfeited in the event that cattle are not sold due to sifting or not arriving at the sale. Cattle arriving and stalled at the sale (including any chosen not to be sold by the consignor) will be charged pro-rated sale costs.

11. Consignors having “no sales” must pay pro-rated sale costs and “no sale” commissions at the price announced by the auctioneer.

12. Substitutes will be allowed if legitimate (death, injury, etc.).

13. No added entries will be accepted after the catalog goes to press.

14. Consignors must be members of the California Angus Association. Non-members will have membership fees deducted from their sale proceeds.

15. Consignors will be responsible for their cattle until delivery arrangements have been made.

16. Consignors are urged to have their trucks and trailers available sale day. All consignors must check in with sale office before leaving sale site for possible deliveries. Consignors who leave without checking in the sales office and if cattle are needed to go their direction will be assessed a penalty to cover any additional hauling fees on those lots.

17. Consignors are urged to send photos and current weights on consignments for possible use in the advertising and/or catalog.

18. The sale may take up to 30 working days to close. Sellers must be aware of the time to collect proceeds, clear checks and pay the bills. Only after all the bills are received can the sale be closed. Proceeds will be sent to consignors only after all consignors paperwork have been completed and payment has been received from the purchaser. All sales and guarantees are between buyer and seller.
